Terms of Service

1. Acceptance of Terms

By accessing or using the website rbclimate.com (the “Website”), scheduling services, or engaging R&B Climate Control Systems (the “Company,” “we,” “us,” or “our”) for any services, you (“Customer,” “you,” or “your”) agree to be bound by these Terms of Service (“Terms”). These Terms constitute a legally binding agreement between you and the Company. If you do not agree to these Terms, do not access the Website or use our services.

These Terms apply to all visitors, users, customers, and others who access the Website or engage our services.

We reserve the right to modify these Terms at any time. Changes will be posted on the Website with an updated Effective Date. Your continued use of the Website or services after changes constitutes acceptance of the revised Terms.

2. Services Provided

The Company provides primarily residential HVAC services, including but not limited to:

  1. Heating and air conditioning repair
  2. Preventive maintenance and tune-ups
  3. System replacement and installation
  4. Mini-split and heat pump systems
  5. Indoor air quality solutions

Limited commercial services may be offered at the Company’s sole discretion. All services (“Services”) are subject to availability and these Terms.

3. Scheduling and Appointments

Appointments may be scheduled by telephone, through the Website’s automated scheduler, or other methods we provide. Appointment times are estimates and provided as arrival windows (e.g., 2-4 hours), not exact times, due to unforeseen circumstances such as traffic, prior job delays, or emergencies.

The property owners are responsible for providing safe, reasonable, and unobstructed access to the property, including unlocking gates, securing pets, clearing work areas, and ensuring safe conditions for our technicians. Failure to provide adequate access may result in rescheduling, cancellation fees, or a trip charge.

4. Cancellations, Rescheduling, and No-Shows

Cancellations or rescheduling require at least 24 hours’ advance notice. Late cancellations, no-shows, or failure to provide access may result in a service fee (e.g., diagnostic or trip charge) at our discretion.

Exceptions for emergencies or severe weather may be granted at our sole discretion.

5. Pricing, Estimates, and Authorization

Quotes provided online, by phone, or otherwise are estimates only and not binding until an on-site evaluation is completed. Diagnostic fees, trip charges, or other service fees may apply and are non-refundable.

No work will commence without your explicit authorization (written). Prices are subject to change based on on-site findings, parts availability, unforeseen conditions, or changes in scope.

6. Payments and Financing

Payment is due in full upon completion of Services unless a prior written agreement provides otherwise. We accept cash, checks, credit/debit cards, online payments, and approved third-party financing options.

Third-party financing is provided solely as a convenience. R&B Climate Control Systems offers financing options through Synchrony Bank to qualified customers.

  1. All financing is subject to credit approval by Synchrony Bank.
  2. Financing terms, interest rates, promotional offers, and repayment schedules are determined solely by Synchrony Bank and are not guaranteed by R&B Climate Control Systems.
  3. Promotional financing (including deferred interest or no-interest offers, if available) may require minimum purchase amounts and timely payments.
  4. Failure to meet promotional terms may result in interest being charged from the date of purchase, as outlined in the Synchrony agreement.
  5. R&B Climate Control Systems does not control credit decisions, account management, billing, or interest charges associated with Synchrony financing.
  6. Customers are responsible for reviewing and agreeing to all financing terms directly with Synchrony Bank prior to approval.
  7. Overdue payments may incur late fees, interest at the maximum rate permitted by law, and/or suspension of Services. We may also pursue collection costs, including reasonable attorney fees.

7. Membership and Maintenance Plans

Enrollment in any maintenance or membership plan is governed by the specific plan agreement provided at signup. Benefits are non-transferable, fees are generally non-refundable, and plans may auto-renew unless canceled in accordance with the plan’s terms.

Missed, unused, or rescheduled visits have no cash value and do not roll over.

8. Warranties and Disclaimers

Equipment warranties are provided solely by the manufacturer and are subject to their terms. Labor warranties, if offered, will be specified in writing at the time of service.

We do not warrant or guarantee system lifespan, efficiency, performance, humidity control, or temperature achievement beyond manufacturer specifications and existing site conditions (e.g., ductwork, insulation, electrical, structural factors).

ALL SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, EXCEPT AS EXPRESSLY STATED IN WRITING.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF USE, DATA, PROFITS, OR PROPERTY DAMAGE, ARISING FROM OR RELATED TO THE SERVICES, WEBSITE, OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

The Company’s total liability shall not exceed the amount paid by you for the specific Service giving rise to the claim.

We are not responsible for pre-existing conditions, damage caused by misuse, neglect, acts of God, or third-party actions.

10. Indemnification

You agree to indemnify, defend, and hold harmless the Company, its officers, employees, agents, and contractors from any claims, losses, damages, liabilities, costs, or expenses (including reasonable attorney fees) arising from your use of the Services, violation of these Terms, provision of access, or negligence.

11. Force Majeure

The Company shall not be liable for delays or failure to perform due to causes beyond our reasonable control, including but not limited to acts of God, weather, labor disputes, supply shortages, pandemics, or governmental actions.

12. Website Use and Intellectual Property

All content on the Website (text, images, logos, designs, etc.) is owned by or licensed to the Company and protected by copyright and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written permission.

Prohibited uses include scraping, data mining, or any activity that imposes an unreasonable load on the Website.

13. Privacy

Your use of the Website and Services is also governed by our Privacy Policy, available on the website, which describes how we collect, use, and protect personal information.

14. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of South Carolina, without regard to conflict of law principles.

15. Miscellaneous

  • Severability: If any provision is held invalid, the remainder shall continue in full force.
  • Entire Agreement: These Terms constitute the entire agreement between you and the Company regarding the subject matter.
  • No Waiver: Failure to enforce any right shall not constitute a waiver.
